  • Third Party Visitation in Washington State after Troxel

    The Washington State legislature has enacted two statutes which allow for a cause of action for visitation with children by a non-parent, third party: RCW 26.09.240 and RCW 26.10.160(3). Both statutes were declared facially unconstitutional by the Washington State Supreme Court. In re Custody of Smith, 137 Wn.2d 1, 969 P.2d 21 (1998), aff’d on other grounds sub nom, Troxel v.
