Considerations When Drafting and Reviewing Pre/Post Nuptial Agreements to Avoid Enforceability Problems

Beginning with the legal standards regarding the enforceability of pre-
and post-nuptial agreements, Mr. Goodwin will address considerations for
the attorney drafting the agreement for an advantaged spouse versus an
attorney that may be drafting or reviewing an agreement from the perspective
of the disadvantaged spouse. This CLE will include topics such as the
advantaged spouse and his/her attorney’s focus on ensuring the drafting
negotiation process is “procedurally fair,” as well as trying
to ensure that the disadvantaged spouse has a substantively fair agreement.
